Please read these Terms and Conditions ("Terms") carefully before using the Elmora Healthcare website at www.elmorahealthcare.com or placing any rental, purchase, or repair order. By creating an account or completing a transaction, you agree to be bound by these Terms.

1. About Us

Elmora Healthcare, LLC ("Elmora Healthcare," "we," "us," or "our") is a durable medical equipment (DME) provider based in Elizabeth, New Jersey. We offer medical equipment rentals, sales, repairs, and a DME Loan Closet program serving North Jersey, Manhattan, and Staten Island.

2. Eligibility

You must be at least 18 years of age to use our Services or place an order. By using our website, you represent that you meet this requirement. Certain products (such as portable oxygen machines) require a valid prescription from a licensed physician. Elmora Healthcare reserves the right to verify prescription documentation before processing such orders.

3. Rental Terms

3.1 Rental Periods

Rentals are available on a daily, weekly, or monthly basis as indicated on each product listing. The rental period begins on the date of delivery or pickup and ends on the agreed return date.

3.2 Security Deposits

A security deposit is required for most rental items, as listed on each product page. Security deposits are held for the duration of the rental and will be refunded within 5–7 business days after the equipment is returned in its original condition, normal wear and tear excepted.

3.3 Equipment Condition & Return

Equipment must be returned in clean condition and free from damage beyond normal wear. Elmora Healthcare will inspect all returned equipment. Customers may be charged for:

  • Damage beyond normal wear and tear
  • Missing accessories or components
  • Excessive soiling requiring deep cleaning

3.4 Late Returns

Equipment not returned by the agreed return date will be charged at the applicable daily rate for each additional day until the equipment is returned.

3.5 Prescription Requirements

Certain equipment (including but not limited to portable oxygen machines) requires written proof of a valid prescription from a licensed physician. Rentals for such equipment will not be processed until prescription documentation is received and verified by Elmora Healthcare.

4. Delivery & Pickup

4.1 Delivery

Elmora Healthcare offers delivery within our service area (North Jersey, Manhattan, and Staten Island). Delivery fees, if applicable, will be disclosed at checkout. We offer 24/7 delivery on a best-efforts basis; specific delivery windows will be confirmed at the time of booking.

4.2 Pickup

Customers may pick up equipment at 162 Elmora Ave, Elizabeth, NJ 07202 during business hours. Pickup times will be confirmed upon booking.

4.3 Delivery Conditions

Risk of loss or damage passes to the customer upon delivery. The customer is responsible for ensuring a safe delivery location is available.

5. Cancellations & Refunds

5.1 Cancellations

Rental cancellations made 48 hours or more before the scheduled delivery or pickup date will receive a full refund.

Cancellations made less than 48 hours before the scheduled delivery or pickup date may be subject to a cancellation fee of up to one day's rental rate.

5.2 Purchases

All sales of equipment purchased outright are final. Returns on purchased equipment may be considered on a case-by-case basis within 7 days of purchase, provided the equipment is unused and in original packaging. Contact info@elmorahealthcare.com to initiate a return request.

5.3 Repair Services

Repair service fees are non-refundable once the repair has been completed.

6. Payments

Payments are processed securely through Stripe and PayPal. By providing payment information, you authorize Elmora Healthcare to charge the applicable rental, purchase, deposit, or service fee to your chosen payment method. All prices are listed in US dollars.

7. DME Loan Closet Program

The DME Loan Closet provides durable medical equipment to qualifying individuals who are unable to afford it. Equipment provided through this program remains the property of Elmora Healthcare and must be returned when no longer needed. Availability of equipment is not guaranteed and is subject to current inventory.

8. Limitation of Liability

8.1 Medical Disclaimer

Elmora Healthcare provides durable medical equipment only. We are not a medical provider and do not offer medical advice, diagnosis, or treatment. All equipment should be used under the guidance of a licensed healthcare professional.

8.2 Equipment Use

Customers are solely responsible for using rental or purchased equipment properly and safely. Elmora Healthcare is not liable for any injury, illness, or damages arising from the misuse or improper use of equipment.

8.3 Liability Cap

To the fullest extent permitted by applicable law, Elmora Healthcare's total liability to you for any claim arising out of or related to these Terms or our Services shall not exceed the amount you paid to Elmora Healthcare in the three (3) months preceding the claim.

8.4 Indirect Damages

Elmora Healthcare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or revenue, even if advised of the possibility of such damages.

9. Equipment Malfunction

If rented equipment malfunctions or becomes unsafe during the rental period through no fault of the customer, contact us immediately at 908-352-8808 or info@elmorahealthcare.com. We will make reasonable efforts to repair or replace the equipment promptly. Elmora Healthcare is not liable for damages resulting from equipment malfunction beyond replacement or repair of the item.

10. Intellectual Property

All content on this website, including text, images, logos, and product descriptions, is the property of Elmora Healthcare, LLC and may not be reproduced, distributed, or used without our prior written permission.

11. Privacy

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

12. Changes to These Terms

We may update these Terms from time to time. The updated version will be effective upon posting, with the "Last Updated" date revised accordingly. Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Union County, New Jersey.
